1. Agreement

These Terms of Service (“Terms”) govern your access to and use of OpenSec websites, accounts, software, security-analysis features, and related services. By using the service, you agree to these Terms. If you use OpenSec for an organization, you represent that you are authorized to accept these Terms for that organization. A separately signed agreement controls if it conflicts with these Terms.

2. Eligibility and accounts

You must be at least 18 and legally able to enter into these Terms. You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Notify us promptly if you believe an account or credential has been compromised.

3. Authorized defensive use

You may use OpenSec only for systems, repositories, code, and data you own or are expressly authorized to assess. You must comply with law, applicable program rules, and third-party rights. You may not use the service to gain unauthorized access, deploy malware, disrupt systems, conceal unlawful activity, harass others, evade safeguards, or test a target without permission.

You may not overload, probe, reverse engineer, resell, or interfere with OpenSec except to the extent such a restriction is prohibited by law. You may not use automated access that bypasses documented interfaces or reasonable rate limits.

4. Your content and repositories

You retain ownership of code, repositories, prompts, files, and other content you submit. You grant OpenSec a limited right to host, copy, analyze, transmit, and display that content only as needed to provide, secure, support, and improve the service you request. You represent that you have all rights and permissions needed to provide the content.

5. Security and AI-generated output

Security analysis can contain false positives, false negatives, incomplete findings, or generated content that requires validation. OpenSec output is decision-support information, not a guarantee that a system is secure and not legal, compliance, or professional advice. You are responsible for reviewing results, testing changes safely, and making deployment and remediation decisions.

6. Early access and beta features

Preview, beta, experimental, or early-access features may change, be incomplete, or stop without notice. Do not rely on them for production continuity unless we agree otherwise in writing. Requesting early access does not guarantee acceptance, timing, capacity, or future availability.

7. Third-party services

OpenSec may interoperate with services such as Google, GitHub, email providers, source-code hosts, and external security tools. Your use of a third-party service is governed by its own terms and privacy policy. We are not responsible for third-party services outside our control.

8. OpenSec rights and feedback

OpenSec and its licensors retain all rights in the service, software, branding, documentation, and underlying technology, excluding your content. If you provide suggestions or feedback, you allow us to use them without restriction or compensation, while we remain responsible for respecting any confidential information covered by a separate agreement.

9. Suspension and termination

You may stop using OpenSec at any time. We may suspend or terminate access when reasonably necessary to address security risk, unlawful or abusive conduct, material breach, nonpayment under an applicable order, or service discontinuation. Where practical, we will provide notice and an opportunity to resolve the issue.

10. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” OpenSec disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that every vulnerability will be identified or that every reported issue is exploitable.

11. Limitation of liability

To the maximum extent permitted by law, OpenSec will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. OpenSec’s aggregate liability arising from the service will not exceed the amount you paid OpenSec for the service during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing. These limits do not apply where liability cannot lawfully be limited.

12. Applicable law and disputes

These Terms are governed by the law applicable to the OpenSec service operator, without overriding mandatory protections available to you. Before filing a formal claim, each party agrees to try in good faith to resolve the dispute by written notice. Courts with lawful jurisdiction may hear unresolved disputes unless a separate written agreement says otherwise.

13. Changes

We may update these Terms as the service changes. We will post the revised Terms and update the effective date. Material changes will take effect after reasonable notice where required. Continued use after the effective date means you accept the revised Terms.

Questions about these Terms may be sent to [email protected].
